Off-Duty Modesto Police Sergeant Killed By DUI Suspect

Matthew Gibbs was driving a Volkswagen when he struck the rear of the off-duty officer's bicycle near Fine and Merle avenues on Tuesday night, according to a statement issued by the California Highway Patrol.

The Modesto Police Department has not named the officer, but CHP says he had been with the department since 2012.

Gibbs faces a homicide charge and two charges related to driving under the influence of drugs or alcohol and causing great bodily injury. The CHP described the victim only as a 38-year-old male. Before joining police, the sergeant was with the Tuolumne County Sheriff's Office.

Investigators say the officer was riding his bike when he was hit from behind. The auto then crashed into a fire hydrant.

At the scene of the collision, around 6: 10 p.m., an arresting officer noticed the driver of the vehicle presented signs of intoxication, according to CHP.

CHP and the Stanislaus County Sheriff's Department are investigating.

Court records show Gibbs in 2015 had a misdemeanor DUI case that was dismissed.
